These Terms of Service ("Terms") govern your use of kuet.us (the "Site") and any purchases made through the Site, operated by MCA TRADE, LLC, a Texas limited liability company ("Kuet," "we," "us," or "our"), with its principal place of business at 2200 S 10TH ST, STE. H10, MCALLEN, TX, 78503.
Please read these Terms carefully before placing an order or otherwise using the Site.
IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION: These Terms contain a binding arbitration provision and class action waiver. Except as otherwise provided below, disputes between you and Kuet must be resolved through individual arbitration rather than in court before a judge or jury or as part of a class action.
By using the Site or placing an order through the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms.
You must be at least 18 years old, or the legal age required to enter into a binding contract in your jurisdiction, to place an order through the Site.
1. Orders & Acceptance
Your order constitutes an offer to purchase the products listed in your order subject to these Terms.
All orders are subject to acceptance by Kuet. We reserve the right to decline or cancel an order at our discretion, including in cases involving product availability, pricing errors, payment issues, suspected fraud, or other circumstances that may affect our ability to fulfill the order.
After your order is placed, we will send you an order confirmation containing your order number and purchase details.
If you need to request a cancellation, contact Customer Service as soon as possible at (956) 200-4670. Once an order has entered processing or shipment, cancellation may no longer be possible.
2. Prices & Payment
Prices displayed on the Site are subject to change without notice. The price charged for a product will be the price shown at the time your order is placed, subject to correction of typographical, pricing, or other errors.
Applicable taxes, shipping charges, and other fees will be displayed during checkout and included in your order total.
We reserve the right to cancel or correct orders resulting from pricing, description, or other errors on the Site.
Payment must be successfully authorized before an order can be accepted and fulfilled.
We accept payment methods made available at checkout, which may include major credit and debit cards and other payment services supported by Shopify.
By submitting payment information, you represent that the information provided is accurate and complete and that you are authorized to use the selected payment method.
3. Shipping & Delivery
Shipping methods, processing times, estimated delivery windows, tracking, shipping restrictions, and related terms are governed by our Shipping Policy, which forms part of these Terms.
Shipping and delivery dates are estimates and are not guaranteed. Delivery may be affected by carrier delays, weather, high-volume periods, or other circumstances outside our reasonable control.

4. Returns, Exchanges & Refunds
Returns, exchanges, and refunds are governed by our Refund Policy, which forms part of these Terms.
Unless otherwise stated in that policy, eligible merchandise may be returned within the applicable return period provided it satisfies the stated return conditions.
Final Sale merchandise is not eligible for return or exchange.
Please review our Refund Policy before completing your purchase.
5. Limited Warranty
THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
Kuet warrants that products purchased directly from the Site will be free from defects in materials and workmanship during the warranty period described below.
To the extent permitted by applicable law, this limited warranty is provided in place of all other warranties, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose, except where such warranties cannot legally be excluded or limited.
Some jurisdictions do not permit certain limitations or exclusions of implied warranties, so these limitations may not apply to you.
Who is covered
This limited warranty applies only to the original purchaser of a product purchased directly from the Site. It does not extend to subsequent owners, transferees, or third parties.
What is covered
The warranty covers defects in materials and workmanship that arise during the Warranty Period.
What is not covered
The warranty does not cover damage resulting from transportation, improper storage, misuse, failure to follow product-care instructions, unauthorized modifications or repairs, normal wear and tear, accidents, abuse, or circumstances outside Kuet's reasonable control.
Warranty period
The Warranty Period begins on the date of purchase and lasts for 30 days.
Repair or replacement of a product does not extend the original Warranty Period unless required by applicable law.
Warranty remedies
For an eligible defective product, Kuet may, at its discretion, repair the product, replace it, or refund the purchase price.
If Kuet elects to repair or replace an eligible defective product, we will cover applicable return shipping and handling associated with that warranty service.
Obtaining warranty service
To request warranty service, email angel@kuet.us during the Warranty Period.
We may require proof of purchase, photographs, product information, or other details reasonably necessary to evaluate the claim.
Limitation of liability under this warranty
To the fullest extent permitted by law, Kuet's liability for an eligible defective product will not exceed the amount actually paid for that product.
Except where prohibited by law, Kuet will not be liable for consequential, incidental, special, punitive, or indirect damages arising from a warranty claim.
Some states do not allow certain limitations or exclusions of damages, so these limitations may not apply to you.
Any dispute relating to this warranty is subject to the dispute-resolution provisions in Section 15 below.
6. Personal Use & No Resale
Products purchased through the Site are intended for personal use unless otherwise agreed by Kuet in writing.
You agree to comply with applicable laws and regulations relating to the purchase, possession, use, resale, and export of products purchased through the Site.
You may not use the Site or purchase products in violation of applicable U.S. export-control laws or regulations.
7. Intellectual Property
The Site and all content on it — including text, graphics, logos, product photography, product descriptions, page layouts, and the Kuet name and marks — are owned by Kuet or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, publicly display, modify, or create derivative works from any content on the Site, or use Kuet's name, logo, or marks, without our prior written consent — except as necessary to place an order or make personal, non-commercial use of the Site.
Nothing in these Terms grants you any license or right to use Kuet's intellectual property beyond what is expressly stated here.
8. Prohibited Use & Indemnification
You agree not to use the Site for any unlawful purpose, to violate any applicable law or regulation, to infringe Kuet's or any third party's intellectual property rights, to interfere with the Site's operation or security, or to resell products purchased through the Site except as expressly permitted under Section 6.
You agree to indemnify, defend, and hold harmless Kuet and its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of:
- your breach of these Terms;
- your misuse of the Site or of products purchased through it;
- unauthorized resale of products; or
- your violation of any applicable law, including export-control regulations referenced in Section 6.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
Kuet's total liability to you for any claim arising out of or relating to your use of the Site or purchase of products, regardless of the theory of liability, will not exceed the amount you actually paid to Kuet for the product(s) giving rise to the claim in the twelve (12) months preceding the claim.
In no event will Kuet be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Site or products purchased through it, even if Kuet has been advised of the possibility of such damages.
Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by Kuet's negligence, fraud, or willful misconduct, or any rights you may have under the Texas Deceptive Trade Practices–Consumer Protection Act that cannot be lawfully waived (see Section 15A).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Privacy
Your use of the Site and any personal information collected in connection with your purchases are subject to our Privacy Policy.
Please review the Privacy Policy to understand how Kuet collects, uses, stores, and protects personal information.
11. Electronic Communications
By placing an order or providing your email address, you consent to receive order confirmations, receipts, shipping notifications, and other transactional communications electronically. These electronic communications satisfy any legal requirement that such communications be in writing.
You are responsible for providing a current, accurate email address and for monitoring it for communications from Kuet.
12. Force Majeure
Kuet will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control.
Such circumstances may include natural disasters, fire, flood, severe weather, governmental action, war, terrorism, civil unrest, public-health emergencies, labor disputes, carrier interruptions, supply shortages, telecommunications failures, power outages, or similar events beyond our control.
13. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision.
Except as required by law, changes apply prospectively: the version of these Terms in effect at the time you place an order governs that order. Continued use of the Site after a revised version is posted constitutes acceptance of the revised Terms for future orders.
14. Governing Law
These Terms and any dispute arising from or relating to them will be governed by the laws of the State of Texas, without regard to conflict-of-law principles that would require application of the laws of another jurisdiction.
15. Dispute Resolution & Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except where prohibited by applicable law, you and Kuet agree that disputes arising from or relating to your purchase of products through the Site will be resolved through individual binding arbitration, rather than through a court trial.
By agreeing to arbitration, you and Kuet waive the right to have covered disputes decided by a judge or jury and waive the right to participate in a class action, representative action, or consolidated proceeding.
Arbitration rules
Arbitration will be administered by the American Arbitration Association ("AAA") under its applicable Consumer Arbitration Rules, except as modified by these Terms.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
The arbitrator will have authority to resolve issues concerning the interpretation, enforceability, or scope of this arbitration agreement, subject to applicable law.
The arbitrator may award any individual relief that would otherwise be available in court.
An arbitration award will be final and binding and may be entered as a judgment in a court of competent jurisdiction.
Right to opt out
You may opt out of this arbitration provision by sending written notice to 2200 S 10TH ST, STE. H10, MCALLEN, TX, 78503 or to angel@kuet.us within 30 days of your first order or first use of the Site, whichever occurs first.
Your notice must include your name, order number (if applicable), and a clear statement that you wish to opt out of arbitration.
Opting out does not affect any other provision of these Terms.
Small claims option
You may elect to bring an eligible individual claim in small claims court rather than arbitration if the claim qualifies for that court and you provide any notice required by applicable law or these Terms.
Individual proceedings only
Arbitration will take place only on an individual basis.
Neither you nor Kuet may combine claims with those of another person or participate in arbitration as a class representative, class member, or in another representative capacity.
If any portion of this arbitration provision is determined to be unenforceable, that provision will be severed to the extent required by law and the remaining provisions will remain in effect.
15A. Texas Consumer Rights Notice
Nothing in these Terms is intended to waive any right or remedy you may have under the Texas Deceptive Trade Practices–Consumer Protection Act ("DTPA") that cannot be lawfully waived.
To the extent applicable law permits a waiver of DTPA remedies and you are not represented by independent legal counsel in connection with these Terms, no such waiver is made or intended by this document.
If you are represented by independent legal counsel and wish to execute a specific DTPA waiver, contact us separately; any such waiver must be a conspicuous, separately signed writing as required by Texas law and is not accomplished by your acceptance of these Terms alone.
16. Assignment
You may not assign your rights or delegate your obligations under these Terms without Kuet's prior written consent.
Any attempted assignment or delegation that violates this provision may be considered invalid to the extent permitted by applicable law.
Kuet may assign its rights and obligations as permitted by law.
17. No Waiver
Kuet's failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
Any waiver must be expressly made in writing by an authorized representative of Kuet.
18. No Third-Party Beneficiaries
These Terms are intended solely for the benefit of you and Kuet and are not intended to grant rights or remedies to any other person, except where otherwise required by law.
19. Notices
We may provide notices relating to these Terms by email to the address associated with your order or account, or by posting an applicable notice on the Site.

20. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.
The remaining provisions will continue in full force and effect.
21. Entire Agreement
These Terms, together with your order confirmation and the policies incorporated by reference — including our Refund Policy, Shipping Policy, and Privacy Policy — constitute the agreement between you and Kuet regarding purchases made through the Site, except where another written agreement expressly applies.
Messaging Terms
If you opt in to receive marketing or transactional text messages from Kuet, additional messaging terms and privacy provisions provided through our messaging service may apply.
